Insurance 03

NEW ORLEANS – A Lafayette man claims he is disabled and was unlawfully denied disability benefits.

Joseph B. Woods filed a complaint on Oct. 18 in the U.S. District Court for the Eastern District of Louisiana against Hartford Life & Accident Insurance Co. alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he suffered, and is continuing to suffer economic loss for not receiving the benefits due to him under plan. The plaintiff holds Hartford Life & Accident Insurance Co. responsible because the defendant allegedly unlawfully denied the benefits he is entitled to under terms of the disability policy.

The plaintiff seeks compensation for all benefits due plus interest, attorney fees, costs of suit and for all other relief as the facts and law may provide. He is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
