St. Tammany Parish couple alleges Slackers Zipline toy broke during use, caused injuries

NEW ORLEANS – A St. Tammany Parish couple claims a woman was injured when a toy she was using broke.

Heather Dempsey and Keith Dempsey filed a complaint on Oct. 25 in the U.S. District Court for the Eastern District of Louisiana against Brand 44 LLC, doing business as Slackers Zipline, alleging that the manufacturer failed to comply with the Louisiana Products Liability Act.

According to the complaint, the plaintiffs allege that on Nov. 22, 2015, Heather Dempsey purchased a Slackers Zipline from Learning Express Toys of Mandeville and installed it in conformity with the instructions. When she attempted to use it, the turn buckle allegedly pulled apart and caused her to fall to the ground, injuring her lumbar and cervical areas. Keith Dempsey alleges the incident caused him to suffer a loss of consortium.

The plaintiffs hold Brand 44 LLC, doing business as Slackers Zipline, responsible because the product was allegedly unreasonably dangerous in its construction and design and did not contain adequate warnings.

The plaintiffs request a trial by jury and seek compensation for all damages, prejudgment interest and for costs of suit and such other relief as the court deems proper. They are represented by Richard P. Voorhies III, James F. Flinn and Jennifer R. Rust of The Voorhies Law Firm in New Orleans.
