Consumer accuses debt collector of unfair practices

NEW ORLEANS — A Metairie man is suing a debt collector, alleging an attempt to collect unauthorized collection fees.

Scott N. Mason filed a complaint Oct. 26 in U.S. District Court for the Eastern District of Louisiana against Navient Solutions Inc., alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, Mason has suffered actual monetary damages because a portion of his payment goes toward the improperly assessed collection costs. The plaintiff alleges Navient Solutions attempted to collect and is still seeking to collect an improperly assessed $12,868.79 collection fee that the defendant is not legally entitled to collect.

Mason seeks trial by jury, compensation for actual damages, statutory damages, attorney fees, court costs and expenses and all other appropriate relief. He is represented by attorney Keren E. Gesund of Gesund & Pailet LLC in Metairie.
