Global Oil Tools Inc. claims cargo was shipped to Romania without authorization, was damaged

NEW ORLEANS – A Houma oil tools manufacturer alleges a common carrier prematurely sent a shipment of tools and that the cargo was damaged in the process.

Global Oil Tools Inc. filed a complaint on Nov. 15 in the U.S. District Court for the Eastern District of Louisiana against the Expeditors International of Washington Inc. & Zurich American Insurance Co. alleging negligence and breach of contract.

According to the complaint, Expeditors International of Washington Inc. was instructed to keep two containers of plaintiff's cargo of oil tools in a bonded warehouse in March until its destination was finalized. The plaintiff holds Expeditors International of Washington Inc. & Zurich American Insurance Co. responsible because Expeditors allegedly prematurely shipped plaintiff's cargo without its authorization and without the issuance of bill of lading and other contract carriage to Romania. The plaintiff alleges its cargo was damaged during this transport and as a result, it was not able to sell the oil tools.

The plaintiff requests a trial by jury and seeks compensation for damages sustained by the oil tools, for all expenses incurred, prejudgment and post-judgment interest, attorney's fees and all other equitable and just relief.
