Former auditor for Amerisafe Insurance Co. seeks payment of allegedly unpaid overtime

LAKE CHARLES – A Missouri man alleges a Deridder business did not pay him overtime wages.

Thomas Michael Fascian, individually and on behalf of other similarly situated, filed a complaint on Nov. 23 in the U.S. District Court for the Western District of Louisiana, Lake Charles Division against Amerisafe Inc., doing business as Amerisafe Insurance Co., alleging that the former employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during his tenure with defendant, he worked an average more than 60 hours per week but was not paid overtime premium for hours worked in excess of 40 in the workweek. The plaintiff holds Amerisafe Inc. responsible because the defendant allegedly failed to pay overtime compensation and failed to record, credit, or compensate him for all the time he was required to work.

The plaintiff requests a trial by jury and seeks compensation for unpaid overtime, plus interest and liquidated damages, costs of litigation, and all other declaratory, injunctive and equitable relief. He is represented by Kenneth D. St. Pé of Kenneth D. St. Pé LLC in Lafayette.
