NEW ORLEANS – A man is seeking damages after he was allegedly injured in an Airbnb rental.

Michael Venci filed a suit against Airbnb Payments Inc., Perfect Park Porch LLC and Carolee Laffoon in the Orleans Parish Civil District Court on Dec. 9.

According to the claim, the plaintiff's mother rented an apartment through Airbnb for the rate of $128 per night in December 2015. The suit states that the plaintiff was in the apartment with his mother when the incident occurred. Due to the purported negligence of the apartment owner and Airbnb, the plaintiff alleges he was caused to fall down a flight of steps while exiting the laundry room and injured his spine.

The defendants are accused of failing to maintain proper lighting, failing to provide a guardrail and failing to use reasonable care.

The plaintiff is seeking more than $75,000 in damages. He is represented by John A. Venezia and Julie O'Shesky of Venezia & Associates in New Orleans and David C. Clement and Leslie J. Hill of Clement, Gates & May in New Orleans.

The case has been assigned to Division E Judge Clare Jupiter.
