GRETNA – The Bank of New York is suing a customer, alleging he owes more than $100,00 for an overdue promissory note.

The Bank of New York Mellon FKA, with the Bank of New York as trustee for the certificate holders of the CWABS Inc, asset-backed certificates Series 2005-1, filed a lawsuit Dec. 21 against John Rochelle in the 24th Judicial District Court, alleging breach of payment and failure to pay off a balance in a timely manner. 

According to the claim, Bank of New York is the holder of a promissory note that was issued by Rochelle. The suit states the plaintiff is owed $106,261.74, plus interest from the defendant.

Bank of New York seeks the $106,261.74, plus interest, attorney fees and court costs. It is represented by attorney Candace A. Courteau of Dean Morris LLC in Monroe.

The case has been assigned to Division N Judge Stephen C. Enright Jr.
