W&T Offshore LLC files suit over expired lease

NEW ORLEANS – A Texas corporation that owns an interest in a Terrebonne Parish property claims leasees on the property are operating without a lease and are not complying with state laws regarding co-ownership of the property.

 

W&T Offshore LLC filed a complaint on Dec. 20 in the U.S. District Court for the Eastern District of Louisiana against Magellan Terminal Holdings LP, Magellan NGL LLC, Magellan OLP LP and Magellan GP LLC seeking declaration of ownership of leasehold improvements and other counts.

According to the complaint, the plaintiff holds an interest in the Gibson Terminal Property in Terrebonne Parish. The plaintiff alleges that plaintiff has suffered damages for not receiving the value of fruits and products flowing through the property. The plaintiff holds Magellan Terminal Holdings LP, Magellan NGL LLC, Magellan OLP LP and Magellan GP LLC responsible because the defendants allegedly failed to extend the lease at the end of its term in September 2013 and has not vacated the leased premises.

The plaintiff requests a trial by jury and seeks an order compelling defendants to provide a full and accurate accounting of their operations, award for the full value of plaintiff's ownership interest, all damages, attorneys' fees and costs.
