Customers allege training facility breached contract by locking them out

NEW ORLEANS – A shooting club is suing an individual and a New Orleans training facility, alleging the defendant changed the locks of its facility to lock out the plaintiffs.

Matthew Courtney and Louisiana Shooters Unlimited/Arete Training Group filed a lawsuit Jan. 5 against Paul Graffeo and Professional Security Training Inc., alleging breach of contract.

According to the complaint, the plaintiffs entered into an agreement with the defendants for the use of a property for training facilities on South Clark Street, New Orleans. The suit states the plaintiffs agreed to a specific price for use of the facilities, but when they tried to access the building, they were locked out, forcing them to incur more charges due to the defendants' breach of contract.

Despite amicable demand, the lawsuit states, the defendants have refused to return the funds to the plaintiffs.

The defendants are accused of breach of contract through changing the locks to the building, forbidding the plaintiffs to enter, failing to provide any notice of cancellation, failing to return payments or files to the students and failing to return the personal effects of students. Additionally, the suit alleges the defendants' negligence due to the maintenance of the air system caused the plaintiff health complications.

The plaintiffs seek all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by attorney Pamela L. Courtney of Fraser, Wheeler & Bergstedt LLP in Lake Charles.

The case has been assigned to Division M Judge Paulette R. Irons.

The Orleans Parish Civil District Court Case number 17-111.
