NEW ORLEANS – A woman alleges her application for employment as a lobby concierge for a New Orleans hotel was rejected because she had previously filed a discrimination complaint.

Claudette Brevé filed a complaint on Dec. 23 in the U.S. District Court for the Eastern District of Louisiana against The Ritz Carlton Hotel Co. LLC, doing business as The Ritz Carlton Hotel New Orleans, alleging that the former employer violated the Age Discrimination in Employment Act.

According to the complaint, the plaintiff alleges that in July 2012, she was terminated from her employment as a lobby concierge for allegedly clocking out early to attend a function as a representative of the hotel. She alleges she filed a discrimination complaint citing the ADEA. In June 2016, the suit states she reapplied for the position online and on July 2, 2016, she received an email from defendant stating the position was not available even though the online status showed that it was still open.

The plaintiff holds The Ritz Carlton Hotel Co. LLC, doing business as The Ritz Carlton Hotel New Orleans, responsible because the defendant allegedly refused to consider and rejected her application for employment in retaliation for filing a charge of age discrimination and filled the position with an individual who had not filed a charge of age discrimination or lawsuit against them. As a result, she alleges she sustained injuries, including the loss of pay, pain and suffering and mental anguish.

The plaintiff requests a trial by jury and seeks an order directing defendant to place her in the position that she would have been, had defendant not discriminated against her, compensatory damages, attorney’s fees and all further equitable relief. She is represented by Dwan S. Hilferty in Metairie.
