BATON ROUGE – The owner of roughly 65 acres in Livingston Parish claims a company trespassed on its property and harvested timber.

VMK Enterprise filed a complaint on Jan. 9 in the U.S. District Court for the Middle District of Louisiana against Weyerhaeuser Co. alleging trespassing.

According to the complaint, the plaintiff alleges that in December 2013, as a result of defendant's timber cutting, plaintiff suffered significant property damages, expenses and losses. The plaintiff holds Weyerhaeuser Co. responsible because the defendant allegedly willfully and intentionally trespassed on plaintiff's property and unlawfully cut, felled, destroyed and sold plaintiff's trees that were outside of the defendant's boundary.

The plaintiff requests a trial by jury and seeks judgment in its favor in an amount sufficient to fully compensate plaintiff's actual and treble damages, attorney’s fees, interest costs, expert fees, and expenses. It is represented by Gary J. Gambel and Michael D. Letourneau of Murphy, Rogers, Sloss, Gambel & Tompkins in New Orleans.
