Couple claims neighbor's renovations exposed them to lead paint dust

NEW ORLEANS – An Orleans Parish couple claims that a neighbor's home renovations exposed them to lead.

Rachel Smith and Andrew Pellett filed a lawsuit Jan. 4 against Aaron R. Dare in Orleans Parish Civil District Court alleging that there was lead in their home.

According to the complaint, the plaintiffs own a home on Harding Drive and that the defendant is their neighbor. They allege Dare's renovations on his property covered their property in a white dust, which they allege tested positive for lead. They allege they were advised to dispose of several of their possessions and their minor child will be monitored for lead exposure.

The defendant is accused of negligence through failing to address the lead paint on his property, failing to obtain permits and other counts.

The couple seeks all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by attorney Carolyn B. Hennesy of Hennesy Law LLC in New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
