Customer blames Winn Dixie for fall, injuries

GRETNA – A customer is suing Winn Dixie, alleging the defendant caused the plaintiff to suffer injuries.

Jeanne Ortego filed a suit Jan. 13 against Winn Dixie Stores Inc and XYZ Insurance Company in the 24th Judicial District Court, alleging negligence.

According to the claim, Ortego was a customer of Winn Dixie at 3001 state Highway 90, Avondale, on Jan. 15, 2016. The suit says Ortego was caused to slip and fall on an object that had been left on the ground. The lawsuit says the fall led to loss of use or function of parts of Ortega's body, disability, mental anguish and loss of pay

The suit says Winn Dixie was negligent through failing to maintain the premises in a safe state, failing to warn of the danger and keep the floor free of obstructions, plus overall negligence.

Ortego seeks all reasonable sums due, attorney fees, court costs and equitable relief. She is represented by attorney Patrick H. Hufft of Hufft & Hufft APLC in New Orleans.

The case has been assigned to Division F Judge Michael P. Mentz.

The 24th Judicial District Court Case number 768173.
