Couple alleges motor home they purchased had many defects

NEW ORLEANS – A Louisiana couple alleges a motor home they purchased had many defects and is seeking rescission of the sales contract.

Diana Gaspard and Minos Gaspard Jr. filed a complaint on Jan. 9 in the U.S. District Court for the Eastern District of Louisiana against Thor Motor Coach Inc., Dixie Motor LLC and Bank of America, National Association alleging that they violated the Magnuson Moss Warranty Act and other counts.

According to the complaint, the plaintiffs allege that on July 8, 2016, they purchased a new 2017 Quantum from Dixie RV for personal use for $89,303.54. When delivered, the vehicle allegedly was defective in materials and workmanship and those such defects substantially impaired its use, value and safety. The plaintiffs hold Thor Motor Coach Inc., Dixie Motor LLC and Bank of America, National Association responsible because the defendants allegedly failed to perform the repair work in a good and workmanlike manner so as to bring it into conformity with the warranties.

The plaintiffs request a trial by jury and seek rescission of the sale and the return of the purchase price, award for incidental and consequential damages, attorney's fees, costs and expenses and all other appropriate relief.
