Family claims the wrong actions doctor, Ochsner Clinic Foundation resulted in relative's death

GRETNA – A family is seeking damages following the death of the father and husband.

Anna Dutton, individually and on behalf of her husband John Dutton, and John Alexander Dutton, individually and on behalf of his father John Dutton filed a lawsuit against Dr. Stephen Bardot and Ochsner Clinic Foundation in the 24th Judicial District Court alleging medical malpractice.

According to the claim, John Dutton was a patient at Oschner Clinic Foundation on July 5, 2012, when he underwent a laparoscopic radical prostatectomy performed by Bardot. A drain was inserted at the site of the surgery to help with the draining of any bodily fluids and was removed the following day. John Dutton was released from the clinic on July 6, 2012, but was readmitted on July 7, 2012, with complaints of nausea and pain. He had to undergo an emergency exploratory laparotomy and was sent to ICU when hemorrhaging was found. John Dutton lost consciousness and experienced cardiopulmonary failure on July 9, 2012, and was pronounced dead that evening, according to the complaint.

The defendant is accused of medical malpractice through failing to take the necessary steps to save the patient, failing to adhere to the appropriate standard of care and failing to properly monitor the patient.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are represented by Vincent J. Glorioso Jr., Maria B. Glorioso and Vincent J. Glorioso III of The Glorioso Law Firm in Metairie.

The case has been assigned to Division A Judge Raymond S. Steib Jr.

The 24th Judicial District Court Case number 768491.
