Capital One sues to recover mortgage balance

GRETNA – Capital One is seeking nearly $50,000 from an unpaid mortgage debt.

Capital One N.A. filed a suit Jan. 26 against Edna Mae Borchers, also known as Edna Mae Borchers Comeaux, in the 24th Judicial District Court, alleging sums due.

According to the claim, the plaintiff allowed the defendant to execute a note for the sum of $87,487.92 on Sept. 23, 2004. The suit said the plaintiff has not received payment on the note. The defendant has failed to pay all amounts as required and is still indebted to the plaintiff for $49,748.98 plus interest.

The defendant is accused of failing to pay off the note as agreed upon.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jason Smith of Dean Morris LLC in Monroe.

The case has been assigned to Division C Judge June Berry Darensburg.

The 24th Judicial District Court Case number 768505.
