Men say they were exposed to mold at worksite

NEW ORLEANS – Two men are seeking damages claiming that the presence of toxic mold on a worksite injured them.

Ryan Delatte and George Lander filed a lawsuit Jan. 23 against Strickland Properties LLC, James C. Strickland III, GHX Industrial LLC, GHX Holdings LLC, Hose Specialty & Supply LLC, Scott Elwood and Jim Riley in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiffs were working at the location of 1404 Destrehan Ave, Harvey, when the incident began to take place. The suit states that the defendants failed to properly warn the plaintiffs of the threat of danger from the presence of toxic mold in the property. After finding the mold on the property on May 28, 2016, the plaintiffs contacted the defendants about the danger, but the defendants failed to check on or repair the issue that was worsening due to a leak on premise. The suit explains that the plaintiffs were caused to suffer from health damages due to the presence of toxic mold.

The defendant is accused of negligence through failing to ensure that the property was safe for humans to work on, failing to warn of the danger or remedy the situation and failing to take the necessary precautions in the first place.

The plaintiffs are seeking all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by attorney R. Brent Cueria of Cueria Law Firm LLC in New Orleans.

The case has been assigned to Division I Judge Piper D. Griffin.
