Jefferson Parish man says insurance company failed to adjust claim quickly

NEW ORLEANS – A Jefferson Parish man is seeking damages for his insurance company's misleading actions.

Freddie Marshall filed a lawsuit Feb. 2 against USAgencies Management Services and Lyndon Southern Insurance Co. in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, Marshall was had a policy with the defendant. The suit states that he was advised that he needed to submit certain proof that he was not at fault in an accident that had taken place Nov. 7, 2015. The suit states that the policy was threatened to be cancelled at that time and that the defendant acted wrongly through a number of events in which the company misled Marshall to make him pay for more than he should have paid following a crash.

The defendant is accused of breach of contract through misleading the plaintiff, failing to adjust the claim in a proper and timely manner and overall breach of the agreement.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. He is represented by Richard Hobbs Barker IV in New Orleans.

The case has been assigned to Division J Judge Paula A. Brown.
