BATON ROUGE – A man alleges a camper he purchased contained defects and is seeking rescission of the sale.
Shane Joseph Taylor filed a complaint on Jan. 30 in the U.S. District Court for the Middle District of Louisiana against Heartland Recreational Vehicles LLC, Camping World RV Sales LLC and Bank of America National Association citing Louisiana Redhibition Laws.
According to the complaint, the plaintiff alleges that on July 5, 2016, he purchased a new 2016 Heartland Gateway from defendant Camping World for a total cost of more than $100,000. When delivered, the plaintiff alleges the vehicle was defective in materials and workmanship, such defects substantially impaired its use, value and safety. The plaintiff holds Heartland Recreational Vehicles LLC, Camping World RV Sales LLC and Bank of America National Association responsible because the defendants allegedly failed to perform the repair work in a good and workmanlike manner so as to bring it into conformity with the warranties.
The plaintiff requests a trial by jury and seeks the remedy of rescission of the sales contract, revocation of acceptance, award for incidental and consequential damages, diminution in value of the vehicle, economic losses, attorney fees, costs and expenses and all other appropriate relief.
