Customer sues Winn-Dixie over slip-and-fall injury

GRETNA – A customer at a Winn-Dixie store claims that she slipped, fell and was subsequently injured due to a slick floor caused by a leaking drink cooler.

Sherry Page of Jefferson Parish filed a suit Feb. 3 against Winn-Dixie Montgomery LLC, PepsiCo Inc, an XYZ Pepsico employee, Winn-Dixie Stores Inc, Sabrina Earin and XYZ Insurance Co. in the 24th Judicial District Court, alleging negligence.

According to the claim, the plaintiff was a customer at the Winn-Dixie located at 3623 Jefferson Highway in New Orleans on May 25, 2016, when the incident occurred. The suit states that the plaintiff was caused to slip and be injured when she encountered a large puddle of water that had been leaking from a PepsiCo drink cooler machine. The plaintiff was caused to suffer both physical and mental pain, the complaint said.

The defendant is accused of negligence through failing to ensure that the machines were in working order, failing to clean up the water, failing to warn of the danger and overall negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Scott Glendening of The Glendening Law Firm LLC in Metairie.

The case has been assigned to Division F Judge Michael Mentz.
