NEW ORLEANS — A husband and wife are suing Home Depot and a power tools supplier, alleging negligence caused injuries to the husband. 

Julie Favaloro and Tait Favaloro, individually and on behalf of their minor daughter, Maci Favaloro, filed a complaint Feb. 8 in U.S. District Court for the Eastern District of Louisiana against One World Technologies Inc. and Home Depot USA Inc., alleging violation of the Louisiana Products Liability Act.

According to the complaint, on Aug. 28, 2016, Tait Favaloro was using the defendants' Ryobi S651D sander when the fan assembly exploded, ejecting pieces of the fan into his face, eye, and ear. 

The suit says Favaloro has suffered serious and permanent injuries resulting in physical and mental pain, lost earnings and medical expenses. The plaintiffs allege the defendants failed to provide a notice of recall for the power tool, negligently designed, produced and sold the defective product and failed to provide adequate instructions and/or warnings to users of the sander.

The Favaloros seek trial by jury, judgment for an amount reasonable in the premises, plus interest, costs of court, and all other equitable relief. They are represented by attorneys Richard C. Trahant of Metairie and Jack E. Morris of Metairie.
