Jefferson Parish couple blames defective shower for wife's injuries

GRETNA – A Jefferson Parish couple is suing a shower company, alleging a defective shower caused injuries to the wife.

Eloisa Guichard and Julio Ortiz filed a suit Feb. 10 against Colony Insurance Co., Maxhome LLC and New Bath LLC in the 24th Judicial District Court, alleging negligence.

According to the claim, Guichard was attempting to use the safety shower July 10, 2016, in her Waggaman home, that had been manufactured and sold by Maxhome and New Bath. The suit states the shower became excessively slippery and Guichard was caused to slip and fall, injuring herself badly.

The lawsuit states the defendants sent a repair team to the plaintiffs' home and the team applied a nonslip texture that should have been applied in the first place. The suit says Guichard is now unable to care for her disabled husband, following the incident.

The defendants are accused of negligently failing to apply the proper coating to the shower, distributing a shower that was unreasonably dangerous and failing to warn the plaintiffs of what could occur.

Guichard and Ortiz seek a jury trial, all reasonable damages and court costs. They are represented by attorneys Ron A. Austin, Ramona G. Fernandez and Jeffrey P. Green of Ron Austin & Associates LLC in Harvey.

The case has been assigned to Division H Judge Glenn B. Ansardi.
