NEW ORLEANS – A family is suing Walmart, alleging the store's negligence caused a relative's death.

Cecil Jean Wheeler, Darnell Wheeler, Travis Wheeler, Samuel Wheeler and Kattie Wheeler Ashby, individually and on behalf of Sandy Wheeler, deceased, filed a lawsuit Jan. 6 against Walmart Louisiana LLC in Orleans Parish Civil District Court, alleging negligence and wrongful death.

According to the complaint, on May 5, 2016, Sandy Wheeler was a customer at the Walmart at 6000 Bullard Ave., New Orleans. The suit says Wheeler fell backward, due to an unknown substance, fracturing his skull, leading to hemorrhaging and subsequent death four days later.

Walmart is accused of breaching its duty through failing to create a safe environment for customers, failing to ensure that there were no risks to guests, and overall negligence in the management of the property.

The family seeks a jury trial, all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by attorneys John W. Redmann, Edward L. Moreno, Travis J Causey and David B. Belk of the Law Offices of John W. Redmann LLC in Gretna.

The case has been assigned to Division L Judge Kern A. Reese.
