Contract 02

NEW ORLEANS –  A Texas company alleges it was not paid for a charter agreement.

Diamond Services Corp. filed a complaint on Feb. 14 in the U.S. District Court for the Eastern District of Louisiana against Hydra OPS LLC alleging that the charterer failed to fulfill its contractual obligations.

According to the complaint, the plaintiff alleges that on July 7, 2015, the parties executed a time charter agreement under which plaintiff’s vessel, the Diamond 85, was chartered to perform certain work on a drill ship, Ensco 8506, owned by ENSCO. On Oct. 28, 2016, the suit states the plaintiff requested payment for the charter party totaling $857,070.58. The plaintiff holds Hydra OPS LLC responsible because in spite of the lapse of 45 days after receipt of the invoice and repeated demands for payment, defendant allegedly failed and refused to pay plaintiff's invoice.

The plaintiff requests a trial by jury and seeks judgment against defendant in the full sum of $857,070.58, together with all costs of this proceeding and attorney’s fees. It is represented by Nicholas F. LaRocca Jr. of Nicholas F. LaRocca Jr. LTD in Morgan City.
