Motorist claims he was injured in accident on I-12

NEW ORLEANS – A Mandeville man alleges he was injured when a truck rear-ended him in Goodbee.

John P. Daniel III filed a complaint on Feb. 15 in the U.S. District Court for the Eastern District of Louisiana against Progressive Express Insurance Co., Miami Trucking Logistics Inc. and Yosmel Dorta alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 22, 2016, he was traveling eastbound on Interstate 12 in Goodbee and was slowing for traffic congestion when defendant Dorta, who was driving a Freightliner truck, negligently rear-ended plaintiff's vehicle. Upon the impact plaintiff was thrown about in the vehicle, the suit states, and as a result, he sustained injuries.

The plaintiff holds Progressive Express Insurance Co., Miami Trucking Logistics Inc. and Dorta responsible because defendant Dorta allegedly failed to maintain careful lookout, failed to exercise due caution and failed to observe traffic conditions.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly, severally, solidarily and vicariously for such sums as are reasonable in the premises, plus interest and all costs of these proceedings.
