Sister alleges brother was denied adequate medical care and supervision at Orleans Justice Center

NEW ORLEANS – A woman alleges her brother was denied appropriate treatment at a facility and has filed a wrongful death suit.

Gaynell Tumblin filed a complaint on Feb. 22 in the U.S. District Court for the Eastern District of Louisiana against Orleans Parish Sheriff Marlin Gusman, Capt. Chad Ruiz, Correct Care Solutions and J. Does 1 - 99 alleging negligent and/or intentional conduct, wrongful death and other counts.

According to the complaint, the plaintiff's brother, Cleveland Tumblin, was arrested and taken to the Orleans Justice Center on Feb. 28, 2016. The plaintiff alleges her brother was diagnosed as having bipolar disorder and had a prescription, which was documented on his medical intake screening. The suit states that on March 5, 2016, while in the shower, Cleveland hanged himself and succumbed to injuries on March 7, 2016.

The plaintiff holds Gusman, Ruiz, Correct Care Solutions and J. Does 1 - 99 responsible because the defendants allegedly failed in their professional duties and their legal obligations by denying appropriate and necessary medical, psychiatric, nursing, and therapeutic care, treatment and supervision for Cleveland Tumblin.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, attorneys’ fees and costs and all other relief as appears just and proper to the court. She is represented by David J. Utter and William R. Claiborne of The Claiborne Firm PC in Savannah, Georgia and John Adcock of Law Office of New Orleans.
