Passenger alleges injuries after wires cause vehicle to jackknife on highway

NEW ORLEANS – A Jefferson Parish man claims he was injured when the vehicle he was riding in was tangled in utility wires while traveling on a highway.

Prather Fitch filed a complaint on Feb. 23 in the U.S. District Court for the Eastern District of Louisiana against Entergy Corp.; Telecommunications Management LLC, doing business as Newwave Communications; Larry Mallery; and Viking Insurance Co. of Wisconsin.

According to the complaint, the plaintiff alleges that on Sept. 13, 2016, he was a guest passenger in a vehicle being operated by defendant Mallery, when the vehicle got tangled upon an electrical wire, causing the vehicle to swirl around and jackknife on the highway. As a result, he alleges he sustained personal injuries, resulting in physical and mental pain, loss wages and medical expenses.

The plaintiff holds the defendants responsible because defendants Entergy and Newwave allegedly failed to properly inspect, replace and/or maintain the utility and/or electrical poles and wires and defendant Mallery allegedly failed to taken into account the safety of others.

The plaintiff requests a trial by jury and seeks judgment rendered in his favor along with all appropriate interest and costs and for all other appropriate and equitable relief necessary and proper.
