Consumer alleges Midland Credit Management keeps calling to reach an unknown third party

NEW ORLEANS – A Ponchatoula consumer alleges a collection agency contacted him multiple times to collect on a debt owed by a third party.

Alan Pearson filed a complaint on Feb. 24 in the U.S. District Court for the Eastern District of Louisiana against Midland Credit Management Inc. alleging that the debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in August 2012, he began receiving calls on his cellular telephone from defendant attempting to collect an alleged debt from a third party unknown to him. The plaintiff claims was charged for each call he received from defendant. The plaintiff holds Midland Credit Management Inc. responsible because despite repeated requests to stop calling her, the defendant allegedly continued to place collection calls and made calls using a prerecorded or artificial voice message. The suit also states that defendant’s collectors behaved in a rude and harassing manner made threats of illegal actions.

The plaintiff requests a trial by jury and seeks injunction requiring defendant to cease all collection efforts against him, statutory damages of $1,500 per call for willful violations and $500 per call for negligent violations of the TCPA, actual damages, attorney’s fees and any other relief that the court deems appropriate.
