Staff member alleges she was physically assaulted by doctor

NEW ORLEANS – A Jefferson Parish woman is suing a doctor, alleging mistreatment.

Robin Malach filed a lawsuit Feb. 24 against Dr. Michael H. Moses and Touro Infirmary Hospital in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, Moses acted in a number of ways that violated what is defined as proper medical behavior, including raising his voice at the staff and committing battery against Malach when he cursed at her and pushed her out of one of the operating rooms on Feb. 17, 2016. Despite complaining about the conduct of the doctor, the suit says, no remedies were made.

The defendant is accused of negligence through failing to protect Malach, failing to hire or supervise in a way that was proper and failing to take the plaintiff's concerns seriously.

Malach seeks a jury trial, all reasonable damages, court costs, attorney fees and all appropriate relief. She is represented by attorney Victor R. Farrugia of Farrugia Law Firm LLC in New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV.
