Nonprofit files suit against FEMA, others seeking relief for Town of Clinton flood victims

BATON ROUGE – A nonprofit Rural Community Housing Development Corp. association and other plaintiffs have filed a suit against federal agencies and others seeking relief for flood victims.

People's Workshop Inc./Department of Feliciana Housing Authority through its president George A. Turner, et al., individually and on behalf of all others similarly situated, filed a complaint on Feb. 24 in the U.S. District Court for the Middle District of Louisiana, East Baton Rouge Division against Federal Emergency Management Agency, Department of Homeland Security John F. Kelly, et al. citing the Stafford Act and other counts and seeking declaratory relief.

According to the complaint, the plaintiffs allege that the defendants have failed to provide assistance to the Town of Clinton residents that were affected by flooding in August 2016. The plaintiffs holds Federal Emergency Management Agency, Department of Homeland Security John F. Kelly, et al responsible because the defendants allegedly continued to fail and/or refused to provide housing assistance to the residents and failed to utilize local property identified as groupsite locations in their community to place FEMA trailers.

The plaintiffs request a trial by jury and seek declaratory and injunctive relief, an order allowing this case to proceed as a class action, award for costs of the suit and such other relief. They are represented by Carol D. Powell Lexing of Law Office of Carol D. Powell Lexing in Monroe.
