Construction and renovation workers allege they were not paid overtime wages

NEW ORLEANS – Construction and renovation workers have filed lawsuit against their former employer over allegations of unpaid overtime.

Hector Barahona, Vicente Munoz, Danilo Correa and Osman Pineda, individually and on behalf of all others similarly situated, filed a complaint on March 1 in the U.S. District Court for the Eastern District of Louisiana against Lynda Vitry alleging that the rental property operator violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they routinely worked an average of 60 hours per workweek without being paid overtime compensation. The plaintiffs hold Vitry responsible because the defendant allegedly willfully failed to pay overtime wages at the rate of one-and-one-half times their regular hourly rate of pay for hours worked in excess of 40 hours per week.

The plaintiffs seek judgment against defendant for all unpaid overtime wages at the applicable rates, liquidated damages, pre- and post-judgment interest, attorneys’ fees and costs and such other and further relief as the court may deem appropriate and just. They are represented by Cesar R. Burgos, Robert J. Daigre, Gabriel O. Mondino and George McGregor of Burgos & Associates LLC in New Orleans.
