NEW ORLEANS – A Louisiana state agency is suing a tire repair company, alleging failure to pay a fee.
The Louisiana Department of Environmental Quality filed a lawsuit Feb. 27 against David Turner, doing business as Felicity Tire Repair, in Orleans Parish Civil District Court, alleging breach of contract and failure to comply with a state law.
According to the complaint, Turner is the sole proprietor of Felicity Tire Repair. The suit states Felicity Tire was audited for compliance with the Waste Tire Program, meaning between March 2011 and December 2015, the defendants failed to return collected waste tire fees to the the plaintiff as required by law.
The suit states the defendants wrongfully collected the balance of $4,658.69.
The Department of Environmental Quality seeks all sums owed, damages, court costs, attorney fees and all appropriate relief. It is represented by attorneys Amber G. Litchfield and Diedra L. Johnson of the Louisiana Department of Environmental Quality in Baton Rouge.
The case has been assigned to Division I Judge Piper D. Griffin.
