Walgreen photo tech alleges she experienced discrimination because of pregnancy

NEW ORLEANS – A pharmacy photo tech alleges she was retaliated against by her employer because of her pregnancy.

Krashaunda Davis filed a complaint on March 6 in the U.S. District Court for the Eastern District of Louisiana against Walgreen Louisiana Co. Inc. and Walgreen Co. citing the Pregnancy Discrimination Act, the Louisiana Employment Discrimination Law and the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that she was hired at the defendants' Harvey pharmacy as a photo tech in 2009 and informed the defendants she was pregnant in 2016. The suit states her doctor put her on a medical restriction of working 30 hours per week because of pregnancy-related high blood pressure, but her supervisor reduced her hours to 29.5 or less, causing her to lose her insurance and benefits. She alleges after she returned to work in July 2016 after giving birth, she was placed on a part-time schedule when she requested a full-time schedule.

The plaintiff holds Walgreen Louisiana Co. Inc. and Walgreen Co. responsible because the defendants allegedly failed to provide reasonable accommodations, refused to return her to a full-time schedule and retaliated against her for taking disability-related leave.

The plaintiff requests a trial by jury and seeks compensatory, punitive and liquidated damages, costs of suit, pre- and post-judgment interest and such other relief as may be just and proper.
