NEW ORLEANS – A Lafourche Parish woman alleges she was injured in an accident with a United States Postal Service employee.
Evelyn Sims filed a complaint on March 7 in the U.S. District Court for the Eastern District of Louisiana against United State of America alleging that the government agency violated the Federal Tort Claims Act.
According to the complaint, the plaintiff alleges that on July 17, 2015, she was lawfully stopped at the intersection of Plantation Road and Lynn Street when she was struck from behind by a vehicle owned by defendant, being driven by its employee, Charles Chiasson Jr. The plaintiff holds United State of America responsible because Chiasson allegedly breached his duty to exercise ordinary care in operating the motor vehicle owned by defendant.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages of no less than $2,204,129 and all other relief the court deems appropriate. She is represented by Brian King, Jason F. Giles and James E. Courtenay of The King Firm LLC in New Orleans.
