MONROE – A Concordia Parish motorist is seeking damages after an accident with an U.S. Army Corps of Engineers employee.

Tammy Smith filed a complaint on March 13 in the U.S. District Court for the Western District of Louisiana against United States of America and the U.S. Army Corps of Engineers alleging that they failed to comply with the Federal Tort Claims Act.

According to the complaint, the plaintiff alleges that on Dec. 17, 2015, she was operating a 2009 Toyota Camry when defendants' employee Lewis Wilkes negligently collided with her vehicle, which caused her to suffer injuries and damages. The suit states that on Sept. 9, 2016, she filed a claim with the U.S. Army Corps of Engineers, seeking the sum certain amount of $24,172. She alleges the defendants are liable for the negligence of their employee.

The plaintiff holds United States of America and U.S. Army Corps of Engineers responsible because the defendants allegedly denied to pay her administrative claim on Nov. 3, 2016.

The plaintiff requests a trial by jury and seeks damages for the sum certain stated herein, interest, all costs of these proceedings and for all general and equitable relief. She is represented by Adam A. Bosso of Morris Bart LLC in New Orleans.
