NEW ORLEANS – A church claims that a pipe problem caused in damages to its property.
St. George's Episcopal Church filed a lawsuit March 23 against The Church Insurance Company of Vermont and Sewerage & Water Board of New Orleans in Orleans Parish Civil District Court alleging breach of contract.
According to the complaint, the plaintiff had an insurance policy with the defendant for its property at 4600 St. Charles Ave. The suit states that in 2015, the board made repairs to an underground water pipe, which had leaked a substantial amount of water under the ground of the church; however, the repairs were not substantial enough, and the church's property was damaged significantly.
The defendant is accused of negligence, breach of contract, breach of duty and good faith and failure to deal fairly with the situation.
The plaintiff seeks all reasonable damages for the destruction of its property, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Brian P. Marcelle of Huber, Slack, Thomas & Marcelle LLP in New Orleans.
The case has been assigned to Division N Judge Ethel S. Julien.
