LAFAYETTE – A man alleges his father died as a result of an allergic reaction because a doughnut shop did not list the allergens in its products.

Brian Allen Jr. filed a complaint on March 16 in the U.S. District Court for the Western District of Louisiana against State Farm Fire and Casualty Co. and Dynasty Donuts LLC, doing business as Ricky Meche's Donut King, alleging negligence.

According to the complaint, the plaintiff alleges that his father died on March 28, 2016, as a result of eating an apple fritter containing walnut flour, which was made and sold by defendant Donut King. The suit states the plaintiff's father had a walnut allergy.

The plaintiff holds State Farm Fire and Casualty Co. and Dynasty Donuts LLC responsible because defendant Dynasty Donuts allegedly failed to provide adequate warning that the apple fritter was made with walnuts.

The plaintiff requests a trial by jury and seeks all damages in an amount reasonable under the premises, interest and costs of these proceedings. He is represented by Charles R. Moore and Corey J. Herbert of Moore & Herbert APLC in Baton Rouge and Dwayne Murray of Murray & Murray LLC in Baton Rouge.
