Motorist seeks damages of $1.5 million after accident with USPS employee

Car accident 33

NEW ORLEANS – A Louisiana man alleges he filed a claim to the federal government after a motor vehicle accident with a federal employee and that the claim has yet to be decided.

Clarence Ventress filed a complaint on March 23 in the U.S. District Court for the Eastern District of Louisiana against United States of America alleging that the government entity failed to comply with the Federal Tort Claims Act.

According to the complaint, the plaintiff alleges that on Aug. 31, 2014, he suffered property damage and personal injury due to an accident caused by the negligence of a U.S. Postal Service employee in New Orleans. The plaintiff alleges he timely presented his claim in writing to the defendant, which has yet to be decided. The plaintiff holds United States of America responsible because the defendant allegedly failed to make its final disposition as to the plaintiff’s claim as more than six months since the claim was presented.

The plaintiff seeks actual damages of $1.5 million, property damages of $18,000, and all other past and future general damages, costs of suit, interest and all other relief as the court deems appropriate. He is represented by Stephen M. Huber, Brian P. Marcelle and Logan S. Albertine of Huber, Slack, Thomas & Marcelle LLP in New Orleans and Edward J. Womac Jr. and Guy S. Parks of Edward J. Womac Jr. and Associates LLC in New Orleans.
