Consumer claims debt collector's letter failed to state that amount would increase over time

NEW ORLEANS – A Natchitoches consumer alleges a debt collector sent her a letter that misrepresented information.

Carolyn Gay, individually and on behalf of all others similarly situated, filed a complaint on March 30 in the U.S. District Court for the Eastern District of Louisiana against Edward F. Bukaty III; Edward F. Bukaty III, a professional law corporation; and Cavalry SPV 1 LLC alleging that they violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Dec. 30, 2016, she received a letter from defendants attempting to collect a debt balance of $10,344.86. The plaintiff holds Bukaty III; Edward F. Bukaty III, a professional corporation; and Cavalry SPV 1 LLC responsible because the defendants allegedly did not advise her that the amount of the debt stated in the letter will increase over time and failed to advise her that no attorney had meaningfully reviewed the account.

The plaintiff requests a trial by jury and seeks damages not to exceed the lesser of $500,000, attorneys’ fees, all costs and expenses and all other relief the court may deem appropriate. She is represented by Keren E. Gesund of Gesund and Pailet LLC in Metairie.
