Woman says Winn-Dixie failed to warn of water on floor

NEW ORLEANS – A woman is seeking damages for a slip and fall in a Winn-Dixie.

Diane Ratcliff filed a lawsuit against Winn-Dixie Stores Inc. and/or Winn-Dixie Montgomery LLC in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff was in the freezer section of the Winn-Dixie at 6400 Tchoupitoulas St., New Orleans on Aug. 4, 2016, when the incident occurred. The suit states that the plaintiff was caused to slip and fall in a puddle of water.

The defendant is accused of negligence through failing to warn of the danger or clean up the mess.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. She is represented by attorney Joseph M. Bruno Jr. of Bruno & Bruno in New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
