St. John woman claims toxic mold in apartment caused health complications

GRETNA – A woman is seeking damages for mold in her apartment.

Tiffany Nelson of St. John Parish filed a suit April 12 against Falling Water LLC, 1st Lake Properties Inc. and ABC Insurance Co. in the 24th Judicial District Court alleging negligence.

According to the claim, the plaintiff entered into a lease with Falling Water on March 6, 2015. The suit states that the plaintiff agreed to lease an apartment at the property in Kenner. The plaintiff found a leak in the apartment and was told that it had been repaired; however, the apartment tested positive for mold in November 2016. The plaintiff claims that the mold resulted in illness and blames the defendant for negligence.

The defendant is accused of negligence and failure to maintain the property in suitable maintenance.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Lauren M. Bergeron of Galante & Bivalacqua LLC in New Orleans.

The case has been assigned to Division C Judge June Berry Darensburg.

The 24th Judicial District Court Case number 770980.
