Man allegedly suffered brain injury after being pushed by The Palace Cafe employee

NEW ORLEANS – A man claims that he was pushed by a restaurant employee, which resulted in permanent injuries.

Douglas V. Johnson, Kim Petersen and Jennifer Johnson filed a lawsuit April 12 against Robert Gurvich and Dickie Brennan and Co. LLC, doing business as The Palace Cafe, in Orleans Parish Civil District Court alleging negligence.

According to the complaint, Johnson was at the defendant's property when he was pushed by the defendant on May 1, 2016. The suit states that the plaintiff was caused to fall backwards and hit his head on concrete, which broke his skull, resulting in a traumatic brain injury and permanent disability.

The defendant is accused of negligence through failing to train, supervise or manage employees properly, failing to prevent injuries to the plaintiff and overall negligence in the treatment of the plaintiff.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Caleb H. Didriksen and Carl A. Woods of Didriksen, Saucier, Woods & Pichon PLC in New Orleans.

The case has been assigned to Division M Judge Paulette R. Irons.
