NEW ORLEANS – A Jefferson Parish consumer alleges he was injured while assembling a cot.

Phil Ramon filed a complaint on April 7 in the U.S. District Court for the Eastern District of Louisiana against Cascade Designs Inc., doing business as Therm-A-Rest, alleging violation of the Louisiana Products Liability Act.

According to the complaint, the plaintiff alleges that on April 8, 2016, plaintiff was assembling defendant's Therm-A-Rest Luxury Lite Cot, when suddenly and without warning, the spring tension spun and fractured bones in his hand, which required a surgical procedure and the installation of hardware. The plaintiff holds Cascade Designs Inc. responsible because the defendant allegedly failed to provide adequate warnings of the dangers during assembly.

The plaintiff requests a trial by jury and seeks all general damages in an amount to be determined according to proof, plus interest, cost of this suit and such other relief that the court may deem just and proper. He is represented by Charles M. Thomas and Logan Albertine of Huber, Slack, Thomas & Marcelle LLP in New Orleans.
