LAFAYETTE – A fiber optic technician has filed a class-action lawsuit against his Scott employer alleging he is owed unpaid wages.
Daniel Timothy Price, individually and on behalf of all others similarly situated, filed a complaint on April 11 in the U.S. District Court for the Western District of Louisiana, Lafayette Division against On Trac Inc. of Tennessee alleging that the employer violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between November 2015 and August 2016, plaintiff worked an average of 60 to 70 plus hours per week for the defendant as a fiber optic technician. The plaintiff holds On Trac Inc. of Tennessee responsible because the defendant allegedly failed to compensate plaintiff at a rate of one-and-one-half times his regular rate of pay for work performed in excess of 40 hours per work week and failed to maintain accurate time records.
The plaintiff requests a trial by jury and seeks an amount equal to his unpaid back wages at the applicable overtime rates, liquidated damages, attorney’s fees, costs and such further relief as the court deems just and equitable. He is represented by Kenneth D. St. Pe of Kenneth D. St. Pe LLC in Lafayette.
