Orleans Parish woman seeking damages for a trip and fall over a speed bump

NEW ORLEANS – An Orleans Parish woman is seeking damages after she tripped and fell on a speed bump.

Marilyn Cutrone filed a lawsuit April 19 against English Turn Property Owners Association Inc. and Nationwide Mutual Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff was running on English Turn Drive on April 23, 2016, when the incident occurred. The suit states that the woman was caused to trip and fall because of the speed bumps that recently had been installed. As a result of the fall, the plaintiff sustained injuries to her elbow, a concussion, cuts, abrasions and more.

The defendant is accused of negligence through failing to place the speed bump in a place where it would be seen, failing to ensure the safety of residents and visitors and overall negligence in relation to the case.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. She is represented by attorney Joseph C. Bartels of the Law Offices of Joseph C. Bartels in New Orleans.

The case has been assigned to Division A Judge Tiffany G. Chase.
