Woman alleges Bank of America incorrectly reported that her mortgage payments were late

BATON ROUGE – An Ascension Parish woman alleges her mortgage payments were wrongfully reported as being paid late.

Shirley Cavalier filed a complaint on April 26 in the U.S. District Court for the Middle District of Louisiana against Carrington Mortgage Services LLC, Bank of America NA, Equifax Information Services LLC, et al. alleging violation of the Real Estate Settlement Procedures Act and the Fair Credit Reporting Act.

According to the complaint, the plaintiff was offered a Home Affordable Modification Program trial modification agreement on her mortgage through Bank of America in 2012. She alleges that she continued to make her mortgage payments but Bank of America reporting the payments as late. The plaintiff holds Carrington Mortgage Services LLC, Bank of America NA, Equifax Information Services LLC, et al. responsible because the defendants allegedly refused to recognize plaintiff's regular mortgage payments, wrongfully reported her payment as being late and failed to reinvestigate.

The plaintiff requests a trial by jury and seeks actual and punitive damages, attorney’s fees and costs and such other and further relief as is appropriate. She is represented by Garth J. Ridge of Garth J Ridge Attorney At Law in Baton Rouge.
