NEW ORLEANS – A Houston man alleges he was injured when departing an Amtrak train in Schriever.

Douglas Victor filed a complaint on May 10 in the U.S. District Court for the Eastern District of Louisiana against National Railroad Passenger Corp., doing business as Amtrak, alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 27 as plaintiff was stepping onto the stool that defendant's employees placed below the doors of the train, it slipped from underneath him, throwing him to the ground. Plaintiff alleges he sustained severe injuries that caused him to suffer physical and mental pain, medical expenses and loss of earnings. 

The plaintiff holds National Railroad Passenger Corp. responsible because the defendant allegedly failed to provide adequate handrails and stable steps for passengers exiting the train and failed to warn plaintiff of the dangerous and unsafe condition.

The plaintiff requests a trial by jury and seeks actual and punitive damages, plus interest, attorney's fees, costs of suit and all other relief to which he may be entitled. He is represented by Walter Naquin Jr. of Naquin Law Firm in Thibodaux and Eric J. Rhine of Spagnoletti & Co. in Houston.
