BATON ROUGE – A nurse practitioner alleges she was wrongfully misclassified as exempt from overtime pay by her former employer.
Adrienne M. Clark filed a complaint on May 11 in the U.S. District Court for the Middle District of Louisiana against Stat Care Clinic LLC, doing business as Central Stat Care, and Dr. Bryan Barrett, also known as Melissa Rose Barrett, alleging that they violated the Louisiana Wage Payment Statute.
According to the complaint, the plaintiff alleges that she was employed by the defendants from January 2016 to February 2017. The plaintiff holds Stat Care Clinic LLC, doing business as Central Stat Care, and Dr. Bryan Barrett, also known as Melissa Rose Barrett, responsible because the defendants allegedly misclassified plaintiff as exempt from the overtime requirements and paid her an hourly wage regardless of the number of hours worked and failed to timely pay final wages.
The plaintiff requests a trial by jury and seeks to recover the unpaid overtime wages, liquidated damages, attorney fees and costs and all such other legal and equitable relief as may be necessary. She is represented by Kenneth D. St. Pé of Kenneth D. St. Pé LLC in Lafayette.
