The Calida Group LLC alleges Elysian mark is being used without consent

NEW ORLEANS – A Las Vegas-based luxury community developer and property manager alleges that one of its marks is being used without its permission.

The Calida Group LLC filed a complaint on May 19 in the U.S. District Court for the Eastern District of Louisiana The Elysian LLC, Latter & Blum Property Management Inc. and Apartments24-7.com alleging trademark infringement.

According to the complaint, the plaintiff is the developer of luxury residential properties under the brand Elysian. The plaintiff alleges that it has suffered and will continue to suffer irreparable injury unless defendants are restrained by the court. 

The plaintiff holds The Elysian LLC, Latter & Blum Property Management Inc. and Apartments24-7.com responsible because the defendants allegedly willfully and intentionally used of the word Elysian in interstate commerce without plaintiff's consent.

The plaintiff requests a trial by jury and seeks an order permanently enjoining defendants from infringing plaintiff's federally registered Elysian trademark, award for actual and statutory damages, attorney’s fees, interest and costs and all further relief as the court shall find equitable.
