Couple alleges Nissan dealership sold them car with water damage

NEW ORLEANS – An Orleans Parish couple claims that they were sold a car with water damage.

Beatrice Allen and Carl Allen filed a lawsuit May 26 against Nissan North America Inc. and Ferguson AG LLC, doing business as Nissan of New Orleans, in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, the plaintiffs purchased a car from the defendant on Aug. 13, 2016. The suit states that while looking at the car, the plaintiffs asked the defendant why there were two foam cups with coffee grounds in them inside the vehicle. The defendant allegedly assured the plaintiff that the cups were there to help the car continue smelling new. The plaintiff discovered a few days after bringing the car home that the smell in the car was nauseating. The plaintiffs discovered water damage to the car, which was causing a mildew smell. The plaintiffs are seeking compensation for the damages suffered.

The defendant is accused of breach of contract and unfair trade practices. 

The couple seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The couple is represented by attorney Ryan P. Reece in Metairie.

The case has been assigned to Division M Judge Paulette R. Irons.
